The program aims to provide financial assistance to cover payroll and certain other expenses to keep employees on the payroll and businesses operational.
Here are the key details and compliance requirements related to the Paycheck Protection Program (PPP):
- Eligibility: Small businesses, nonprofits, sole proprietors, independent contractors, and certain self-employed individuals are generally eligible for PPP loans. The eligibility criteria may vary depending on the specific program rules in effect at the time of application.
- Loan Use: PPP loans are intended to cover certain expenses, primarily payroll costs. These include employee salaries, wages, tips, benefits, and certain taxes. A portion of the loan amount can also be used for mortgage interest, rent, utilities, and interest on other debt obligations incurred before February 15, 2020.
- Loan Forgiveness: PPP loans may be fully or partially forgivable if certain conditions are met. The primary condition is that at least 60% of the loan proceeds must be used for payroll costs. The remaining 40% can be used for eligible non-payroll expenses. To qualify for full loan forgiveness, businesses must maintain employee and compensation levels, and use the funds within a specified covered period.
- Loan Terms: PPP loans have a maturity of five years and an interest rate of 1%. No collateral or personal guarantees are required. The loans are non-recourse, meaning the borrower is not personally liable for repayment if the loan is used for its intended purposes and the forgiveness requirements are met.
- Application Process: PPP loans can be obtained through participating lenders, including banks, credit unions, and online lenders. The Small Business Administration (SBA) oversees the program. Applicants need to provide certain documentation, such as payroll records, tax forms, and financial statements, to support their loan application.
- Compliance and Documentation: PPP loan recipients are required to maintain proper documentation and records to substantiate their eligible expenses. This includes keeping records of employment levels, payroll documentation, expense receipts, and other relevant financial documents. These records should be retained for at least six years after the loan forgiveness date.
